General Terms and Conditions

PLEASE NOTE: The English version of the GTC (general terms and conditions) is a service and for information only, solely the German original is of binding validity!

The following terms and conditions (GTC) are part of those contracts with

Michael Morgenbesser,
Columbusgasse 43/4,
1100 Wien,

hereinafter also referred to as Wiener Wandern, which fall into the business of guided mountain hiking tours and are marketed under "Wiener Wandern" and "".

1. Registration

The booking of a guided (mountain) hiking tour or the registration for an advertised event takes place in these steps:
- only for our offer for single hikes ( a one-time registration is required
- with an appointment request via our booking system or by phone
- and after the appointment confirmation via (e-mail) with the completion of the booking and an online payment.

By registering or by contacting us by phone or e-mail, you accept our terms and conditions (from the time of booking on behalf of all participants in your group).

The contract will only become valid with the completion of your booking and the written confirmation (by e-mail) from Wiener Wandern.

If an advertised minimum number of participants is not reached, the advertised hike can be canceled by us until the day before the event.

2. Terms of payment

The full amount must be paid in advance as part of the booking using one of the provided online payment methods. Only for corporate customers and regular customers a payment on account is possible!

Possibly advertised third party providers (cable cars, lifts, etc.) must be paid by yourself on site. We try to inform you in the best possible way about the costs of third-party providers, but can not guarantee the prices quoted. As this is not a package offer, each participant pays his own costs locally. This includes accommodation, meals, other advertised service providers and other personal, individual expenses.

The accounting is done exclusively by electronic means (a PDF will be sent by e-mail).

3. Warranties

By booking, the participant agrees to the reservation or booking of mentioned third party providers. Wiener Wandern requires a fee exclusively for organizational services in advance and during the hike, no flat rate.

You declare your agreement that we will commission the advertised third-party providers for you in your name and bear the full responsibility and the full risk (also for failure, etc.). We therefore assume no responsibility for the quality or any defects in accommodation, other hosts or promoters, booked third party providers, etc., defects in these are between you and the respective provider to discuss and ensure. Due to a lack of third party providers of the event mediated by us, there is no entitlement to reduction, compensation or termination.

If, despite our careful preparation, there is a defect in the organization or during the guided (mountain) hiking tour, we ask you to inform the guide immediately so that the defect can be rectified immediately if possible.

We point out that our offer is always exposed to unforeseen influences on group dynamics and conditions for activities such as individual fitness and preferences of the participants, weather conditions etc. These are not directly influenced by the organizer and are not subject to any warranty.

In particular, we would like to point out that we do not guarantee the identical, complete execution of the tour as advertised due to the nature of (mountain) hiking tours. The dimensioning of the tour is planned carefully, but may differ on the basis of already mentioned influencing factors and can also be changed spontaneously on site. If a large part of the group wants to abbreviate a sub-stage, this is usually organized by the guide. An abbreviation or a cancellation of a section does not constitute a warranty or reimbursement claim or a price reduction.

In addition, the guide can not guarantee to be able to cope with any walking pace, which is due to the hiking in the group. As a rule, he will look after the weaker ones. If, however, in the run-up to the tour were given false information regarding their own condition or the self-assessment was wrong, the tour can go as advertised, the guide can not guarantee a take on the tour. If the guide advises a participant to cancel the tour and can no longer depend on his speed, this also does not give rise to a warranty or refund claim. This also applies in the event that participation is prohibited because of inadequate hiking equipment.

In case of bad weather, which is a danger for the participants, we are entitled to choose an alternative and equivalent tour. If it is not possible to avoid the danger, it will be canceled.

If the tour is canceled by Wiener Wandern, all payments already made will be refunded.

4. Liability and limitations of liability

You book with us an activity in nature. This exposes you to risks that we can not influence. Everyone is responsible for their own health and is responsible for assuming this responsibility during the booked activity. The guide is available as a consultant, but can not assume any liability for the health of the participants. We are not explicitly liable for injuries / body damage / recovery costs. All participants always participate at their own risk.

The participants agree with their booking with the presented in the selection of other service providers, for which we assume no liability.

Wiener Wandern is not liable for goods taken along.

Wiener Wandern is not liable for visiting caves or the use of via ferrata. If a participant decides to visit or use, this is at her/his own risk. Obligations vis-à-vis third-party providers or other service providers that are booked by us as part of the hike we organize may be paid separately by the participants (see point 3).

8. Physical requirements and required equipment

Hiking places a higher physical requirement on you than you are used to in everyday life. The tours we offer are designed to be handled by a healthy person, but only you or your doctor can judge if your health and condition are equal to the requirements of each tour. You must be able to walk according to the time specified and must not be restricted for health reasons.

You are responsible for observing the usual rules of conduct and in particular precautions when hiking - also in terms of equipment in hiking baggage - as they are propagated by hiking clubs and for all damages that you cause.

You should have suitable hiking material, especially hiking boots and rain / weather protection, to participate in our tours. We provide you with a packing list as an aid. Ultimately, you are responsible for your individual health on the tour.

The clothes must be appropriate to the weather and the season, consist of sturdy shoes and comfortable / weatherproof clothing. In case of insufficient clothing, especially in case of unsuitable footwear, the guide has the right to exclude you from the tour.

9. Insurance

Wiener Wandern recommends you to take out travel cancellation insurance, travel luggage and travel health insurance. We recommend that you first check with your insurance advisor about existing protection from existing insurances (often included in memberships of motorist clubs, alpine clubs, etc.). This should be included above all a (helicopter) salvage.

Wiener Wandern has a public liability insurance.

10. Personal data and photo publications

Personal data is stored only for internal processing. They are not passed on to third parties for advertising purposes or other specialized purposes. The request for deletion of the data must be communicated to Wiener Wandern in writing. Wiener Wandern informs all interested parties and participants of previous hikes about future activities and news about our service only via social networks and our newsletter.

During the hiking tours the participants and the guide take pictures. Almost all participants want an exchange of recordings. Wiener Wandern therefore offers to exchange photos on an internet platform (Dropbox, Google Drive) after the tour, unless it is a singles event.

Wiener Wandern may publish photos of the hiking tours on its website, its social media appearances or in its publications. In portraits, the permission of the depicted person is obtained before publication. Group recordings will be published without further consultation. Participants who expressly do not wish to do so must notify in writing before starting the hiking tour.

More information can be found in our privacy policy.

11. Final provisions

The invalidity of individual provisions of the General Terms and Conditions does not result in the invalidity of the remainder of the Terms and Conditions or the entire contract. Misprints and errors on the website and all the material provided, including the tour description, packing list and the terms and conditions, reserves Wiener Wandern. Place of performance is Vienna. In the event of a dispute, only the local jurisdiction of the competent court for the registered office of Wiener Wander shall be deemed agreed.
