General Terms and Conditions

PLEASE NOTE: The English version of the GTC (general terms and conditions) is a service and for information only, solely the German original is of binding validity!

The following terms and conditions (GTC) are part of those contracts with

Michael Morgenbesser,
Columbusgasse 43/4,
1100 Wien,

hereinafter also referred to as Wiener Wandern, which fall into the business of guided mountain hiking tours and are marketed under "Wiener Wandern" and "wienerwandern.singles".

1. Registration

The booking of a guided (mountain) hiking tour or the registration for an advertised event takes place in these steps:
- only for our offer for single hikes (wienerwandern.singles) a one-time registration is required
- with direct booking of an available appointment with our booking system or a written/telephone inquiry
- and online payment.

By registering or by contacting us by phone or e-mail, you accept our terms and conditions (from the time of booking on behalf of all participants in your group).

The contract will only become valid with the completion of your booking and the written confirmation (by e-mail) from Wiener Wandern.

If an advertised minimum number of participants is not reached, the advertised hike can be cancelled by us until the day before the event.

2. Terms of payment

The full amount must be paid in advance as part of the booking using one of the provided online payment methods. Only for corporate customers and regular customers, a payment on account is possible!

Possibly advertised third party providers (cable cars, lifts, etc.) must be paid by yourself on site. We try to inform you in the best possible way about the costs of third-party providers, but can not guarantee the prices quoted. As this is not a package offer, each participant pays his own costs locally. This includes accommodation, meals, other advertised service providers and other personal, individual expenses.

The accounting is done exclusively by electronic means (a PDF will be sent by e-mail).

3. Warranties

If despite our careful preparation, there is a defect in the organization or during the guided (mountain) hiking tour, you have to inform the guide immediately so that the defect can be rectified immediately if possible.

We point out that our offer is always exposed to unforeseen influences on group dynamics and conditions for activities such as individual fitness and preferences of the participants, weather conditions etc. These are not directly influenced by the organizer and are not subject to any warranty.

In particular, we would like to point out that due to the nature of mountain hiking tours/hiking tours, we do not guarantee that the tour will be carried out identically and in full as advertised. The dimensioning of the tour is carefully planned, but may vary based on the influencing factors already mentioned and may need to be changed spontaneously on site.
In the event of missing or incorrect information, incorrect self-assessment or inadequate equipment of the guest, the hiking guide can refuse to take you with him or abort the tour. Termination or any changes are also possible in the event of emergencies.
A denied take away, changes or abortion of the tour do not constitute a guarantee or refund claim or a price reduction.

In addition, the hiking guide cannot guarantee that you will be able to meet every walking pace, which is due to hiking in a group. As a rule, he will follow the underachievers. The walking and driving times given in the description are average values. Supported locations such as mountain huts or inns could be closed. The requirements correspond to our personal assessment and may differ from your feelings.

In bad weather conditions that pose a danger to the participants, we are entitled to choose an alternative and equivalent tour, to suggest an alternative date or to cancel the tour.

4. Liability and limitations of liability

You book with us an activity in nature. This exposes you to risks that we can not influence. Everyone is responsible for their own health and is responsible for assuming this responsibility during the booked activity. The guide is available as a consultant, but can not assume any liability for the health of the participants. We are not explicitly liable for injuries/body damage/recovery costs. All participants always participate at their own risk.

Wiener Wandern is not liable for goods taken along.

Wiener Wandern is not liable for visiting caves or the use of via ferrata. If a participant decides to visit or use, this is at her/his own risk. The participant may remove from the group and from the responsibility for this purpose, only after agreement with the guide. Other participants must not be endangered.

Wiener Wandern is an organizational service that leads to no damage. Should there nevertheless be any damage caused by us, the contractual liability of Wiener Wandern is limited to the agreed price, unless the damage was caused deliberately or through gross negligence.

5. Performance and prices

The scope of the contractual service results from the route descriptions and announcements on www.wienerwandern.at and wienerwandern.singles. The prices to be paid can be found in the tenders. Offers on partner portals may vary.

The organizational service to be provided by Wiener Wandern includes:

  • Preparation of mountain hiking tours and guided tours or the detailed planning of a booked tour,
  • Provision of information pages on www.wienerwandern.at and wienerwandern.singles including packing and checklist for preparation (alternatively, this can also be done via e-mail),
  • telephone and written (by e-mail) information, whether the tour is suitable for the interested, to clarify individual questions and advice regarding hiking equipment,
  • Provision of further necessary information,
  • Guided hiking tour from the starting point on site,
  • optional couching during the tour.

The pricing of Wiener Wandern refers to these services. Costs beyond these organizational services are to be provided by the participant. Thus, the total cost of the hiking tour depends heavily on your individual needs and preferences, e.g. in terms of food.

The visit of caves or the use of via ferrata are not part of our service!

If necessary, we offer a free ride for up to 4 people from a described collection point in Vienna. This transfer is not part of our offer.

6. Vouchers

Promotional vouchers are valid in the specified period, but no later than one year after the start of the action.

Vouchers are valid for 5 years from the date of purchase. Thereafter, the voucher expires and can no longer be redeemed.

A cash discount of vouchers is not possible.

7. Cancellation of the booking, cancellation of individual participants

You can cancel a booking at any time without giving reasons, this must be in writing (for example by e-mail). Any refund will be made according to the following criteria:

  • Up to 30 days before the agreed date, the cancellation is free of charge, all payments already made will be returned.
  • From 30 days before the agreed date, no refund will be made.
  • No refund will be given in the event of late or late arrival, early termination or if participation is prohibited due to insufficient equipment.
  • Reservations made through resellers (such as Viator) are subject to the applicable cancellation policy as displayed by the reseller at the time of booking.

The registration is in principle personal. It requires the permission of Wiener Wandern, so that another person can replace the registered.

Wiener Wandern is entitled to cancel bookings if there is a risk for the participants, a minimum number of participants is not reached, the hiking guide falls ill or the service cannot be performed in general. If no alternative date is agreed, all payments already made will be reimbursed.

8. Physical requirements and required equipment

Hiking places a higher physical requirement on you than you are used to in everyday life. The tours we offer are designed to be handled by a healthy person, but only you or your doctor can judge if your health and condition are equal to the requirements of each tour. You must be able to walk according to the time specified and must not be restricted for health reasons.

You are responsible for observing the usual rules of conduct and in particular precautions when hiking - also in terms of equipment in hiking baggage - as they are propagated by hiking clubs and for all damages that you cause.

You should have suitable hiking material, especially hiking boots and rain/weather protection, to participate in our tours. We provide you with a packing list as an aid. Ultimately, you are responsible for your individual health on the tour.

The clothes must be appropriate to the weather and the season, consist of sturdy shoes and comfortable/weatherproof clothing. In case of insufficient clothing, especially in case of unsuitable footwear, the guide has the right to exclude you from the tour.

9. Insurance

Our offer does not include travel cancellation insurance, luggage and travel health insurance. We recommend that you contact your insurance advisor beforehand to find out about existing protection from existing insurance (often included with membership in motorist clubs, alpine clubs, etc.) and to take out appropriate insurance if necessary. In particular, a (helicopter) salvage should be covered.

Wiener Wandern has a public liability insurance.

10. Personal data and photo publications

Personal data is stored only for internal processing. They are not passed on to third parties for advertising purposes or other specialized purposes. The request for deletion of the data must be communicated to Wiener Wandern in writing. Wiener Wandern informs all interested parties and participants of previous hikes about future activities and news about our service only via social networks and our newsletter.

The hiking guide is entitled to take photos. The photos are made available to all participants free of charge on an internet platform (Dropbox, Google Drive) and may be used by you for non-commercial purposes.

You expressly agree that photos taken by you or made available to us may be stored and used by us without a proof of name and without publication fee to illustrate tour descriptions and may be used in social networks. Participants who do not wish to do this must inform us in writing before the start of the hiking tour.

More information can be found in our privacy policy.

11. Final provisions

The invalidity of individual provisions of the General Terms and Conditions does not result in the invalidity of the remainder of the Terms and Conditions or the entire contract. Misprints and errors on the website and all the material provided, including the tour description, packing list and the terms and conditions, reserves Wiener Wandern. Place of performance is Vienna. In the event of a dispute, only the local jurisdiction of the competent court for the registered office of Wiener Wander shall be deemed agreed.
